Found out my landlord has been charging me for a parking spot that the city says is a public alley
I pulled the property records for my building in Cleveland from the county website and there was a 1978 easement showing the strip behind the house is a public right of way. My lease has a $75 monthly parking fee for that exact spot. I asked a tenant lawyer about it at a free clinic and he said that could count as unjust enrichment, which I had never heard of before. I still owe rent so I'm not trying to get evicted over $900. Has anyone actually gotten money back from a landlord for fees like this without it blowing up?
Watched a neighbor fight his landlord over a bogus $40 trash fee and he won, but only after six months of small claims hassle and a real chill in the hallway after that. So yeah, it's doable, just know the money and the mood both take a hit.
