Pro tip: my cousin's offhand advice about filing my small claims case in the wrong county cost me $75
My cousin is a paralegal in Mesa and when I got stiffed on a $2,100 job last March she told me to just file in my home county because it's easier. Turns out the venue rules say you have to file where the defendant lives or does business, and the judge tossed my case on that alone. I refiled in Maricopa County and won, but I ate the $75 filing fee twice and lost two months. Does anyone know if there is a way to get that first fee back or am I just out of luck?
